SMS Terms & Conditions

By providing your mobile phone number and affirmatively opting in to receive text messages from Profitified (e.g., by texting a keyword, completing a web form, or checking an opt-in box), you expressly consent to receive recurring automated promotional and informational text messages from Profitified at the mobile number you provide.

Your consent is not a condition of any purchase or service. Message and data rates may apply. You may opt out at any time (see Section 6). Consent is specific to each program you enroll in and does not apply to separate programs unless separately indicated.

By opting in, you represent that you are the account holder for the mobile number provided, or that you have the account holder's permission to enroll in the program.

Message frequency varies by program and your interaction with Profitified. You may receive up to [X] messages per month depending on the specific program(s) to which you are subscribed. Profitified operates the following SMS programs:

• Property Alerts: Automated notifications about new listings, deal opportunities, and market updates relevant to your stated interests.
• Transaction Updates: Transactional messages related to active deals, closing timelines, document requests, and appointment confirmations.
• Promotional Offers: Periodic promotional messages about Profitified services, special programs, and exclusive investor or homeowner opportunities.
• Support & Follow-Up: Conversational messages from Profitified representatives responding to your inquiries or following up on submitted deals.

Message and data rates may apply. Standard SMS and MMS message rates charged by your mobile carrier may apply to each text message sent and received. Profitified does not charge you for text messages, but your carrier's standard messaging rates will apply.

If you are unsure about your plan's messaging rates or data charges, please contact your mobile carrier before opting in. Profitified is not responsible for any charges imposed by your mobile carrier in connection with text messages sent or received.

Carrier availability is subject to change. Not all features may be available through all carriers. Profitified is not liable for delayed or undelivered messages due to carrier limitations or outages. Carriers are not liable for delayed or undelivered messages.

You may opt out of Profitified's SMS program at any time. To stop receiving text messages, use one of the following methods:

After opting out, you may still receive non-promotional transactional messages required to complete an active transaction or fulfill a legal obligation. To re-enroll in the program, text START or follow the original opt-in process.

Wireless carriers are not liable for undelivered or delayed messages. Profitified does not guarantee that all messages will be delivered to all devices, and message delivery is subject to effective transmission from your network operator. Profitified is not responsible for any delays, failures, or errors in transmitting messages through any carrier network.

Text messaging services may not be available in all areas or on all mobile devices. Profitified reserves the right to terminate any SMS program at any time, with or without notice.

Profitified's SMS programs are intended to comply with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable Federal Communications Commission (FCC) regulations, as well as any state laws governing automated text messaging and electronic communications.

By opting in, you acknowledge and agree that:

• •Profitified may use automated dialing systems or pre-recorded voice messages in connection with its SMS programs.
• •Your consent is not required as a condition of purchasing any goods or services from Profitified.
• •You have the right to revoke consent at any time using the opt-out procedures described in Section 5.
• •Nothing in these Terms limits any rights you may have under applicable law.

TO THE FULLEST EXTENT PERMITTED BY LAW, PROFITIFIED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SMS PROGRAMS, INCLUDING BUT NOT LIMITED TO:

• •Delayed or undelivered messages due to carrier issues, network outages, or technical failures.
• •Unauthorized access to your mobile device or account.
• •Any data charges, fees, or costs incurred by you in connection with receiving SMS messages.
• •Errors, inaccuracies, or omissions in any message content.
• •Any actions you take or fail to take based on the content of our messages.

In no event shall Profitified's aggregate liability arising from or related to our SMS programs exceed the greater of (a) the total amount paid by you, if any, for participation in the program during the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

Any dispute, claim, or controversy arising out of or relating to these SMS Terms and Conditions or Profitified's SMS programs shall be resolved exclusively through binding individual arbitration under the rules of the American Arbitration Association (AAA), to the extent permitted by applicable law.

Class Action Waiver: You agree to resolve any disputes with Profitified on an individual basis only, and not as part of any class or representative action.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of [STATE], without regard to its conflict of law principles.

Informal Resolution: Before initiating arbitration, you agree to first contact Profitified at connect@profitified.com and describe your complaint in detail. We will attempt to resolve the dispute informally within thirty (30) days.

Profitified reserves the right to modify these SMS Terms and Conditions at any time. Material changes will be communicated to enrolled users via SMS or other reasonable means prior to taking effect. Your continued participation in any SMS program following notice of changes constitutes your acceptance of the revised terms.
